Gas Happy Terms of Service

Welcome to Gas Happy.
By creating an account or using the Gas Happy mobile application (the "App"), you agree to these Terms of Service ("Terms") and our Privacy Policy. If you do not agree, do not use the App.
1. Eligibility
You must be at least 13 years old (or the minimum legal age in your jurisdiction) to use Gas Happy.
2. Accounts
You are responsible for your account and all activity under it. You must provide accurate information and keep your credentials secure.
3. User Content
Gas Happy allows you to upload content such as vehicle builds, images, performance metrics, and descriptions ("User Content").
You retain ownership of your User Content. By posting User Content, you grant Gas Happy a worldwide, non-exclusive, royalty-free license to host, store, cache, display, reproduce, and distribute your User Content within the App and in connection with operating, promoting, and improving Gas Happy. We may make technical modifications to your content (for example, resizing or reformatting) to display it properly.
You represent that you have all rights necessary to post your User Content and that your User Content does not violate applicable laws or third-party rights.
4. Prohibited Use
You agree not to:
- Post illegal, misleading, infringing, or deceptive content
- Promote unsafe or illegal driving behaviour
- Falsify performance data or verification evidence
- Manipulate rankings, promotions, giveaways, or outcomes
- Harass, impersonate, or abuse other users
- Attempt to interfere with the App’s security or operation
5. Rankings, Metrics & Verification
Performance metrics, rankings, and verification indicators are provided for entertainment and community comparison purposes only.
We do not guarantee accuracy, fairness, or real-world performance. Verification processes, ranking formulas, categories, and criteria may change, be paused, or be removed at any time.
You must not rely on Gas Happy for mechanical, engineering, safety, or legal advice.
6. Promotions, Giveaways & Sponsored Content
Gas Happy may run promotions, giveaways, contests, or partner with third parties including automotive brands, sponsors, and advertisers.
Participation may be subject to additional rules, eligibility requirements, and time limits. Prizes, rewards, or benefits are not guaranteed and may be substituted, modified, or withdrawn where permitted by law.
Sponsored or promoted content may be displayed within the App. Gas Happy is not responsible for third-party products, services, fulfillment, warranties, or claims.
Unless explicitly stated otherwise, promotions are not endorsed by platform providers (Apple, Google).
7. Advertising & Partnerships
The App may display advertisements, featured builds, sponsored placements, or partner content.
Inclusion of sponsored or featured content does not imply endorsement by Gas Happy. We are not responsible for the quality, legality, or accuracy of third-party offerings.
8. Safety Disclaimer
Vehicle modification and driving activities can be dangerous. You are solely responsible for your actions and for complying with all applicable laws and regulations. Do not use the App in a way that encourages unsafe driving.
9. Moderation & Removal
We may remove content, restrict features, or suspend accounts if we reasonably believe it violates these Terms, applicable law, or poses risk to users or the platform.
10. Termination
You may stop using the App at any time. We may suspend or terminate access if you violate these Terms or if necessary to protect Gas Happy or its users.
11. Disclaimers
Gas Happy is provided "as is" and "as available". We make no guarantees regarding availability, accuracy, or uninterrupted operation.
Nothing in these Terms excludes rights that cannot be excluded under applicable consumer law.
12. Limitation of Liability
To the maximum extent permitted by law, Gas Happy is not liable for indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the App.
13. Indemnity
You agree to indemnify and hold Gas Happy harmless from claims arising out of your User Content, your use of the App, or your violation of these Terms.
14. Changes
We may update these Terms as the App evolves. If we make material changes, we may provide notice in the App or by other reasonable means. Continued use after changes means acceptance.
